THE HONORATO CASE AND OTHERS VERSUS BRAZIL: BRAZILIAN POLICE VIOLENCE AND LETHALITY ONCE AGAIN IN THE SIGHTS OF THE INTERAMERICAN COURT OF HUMAN RIGHTS
Abstract
This work sought to analyze the position of the Inter-American Court of Human Rights (IDH Court), in aspects involving the excessive use of police force, focusing on the case of Honorato et al. versus Brazil. Based on the Brazilian history in relation to police lethality before the Inter-American Court of Human Rights – with the decision in the Favela Nova Brasília case –, the question arises: what are the main violations and determinations present in the ruling in the Case of Honorato et al. versus Brazil? Therefore, in order to resolve this issue, it is necessary to understand the relationship between the Inter-American Human Rights System and Brazil, as well as the development and application of the Favela Nova Brasília decision, one of the first Brazilian convictions regarding this issue, and in the end, analyze the decision that is the subject of this work. Furthermore, the deductive approach method was used, starting from the analysis of the protective standards established by the Inter-American Court of Human Rights in the Favela Nova Brasília case for the specific analysis of the elements highlighted in the Honorato et al. case versus Brazil, judged by the Inter-American Court of Human Rights in order to understand the main violations and determinations present in the sentence, as well as the analytical procedure method and the bibliographic research technique.Downloads
