Abstract

This work addresses the foundations and facts of the paradigms of Themes 881 and 885 of the Federal Supreme Court, focusing on legal certainty and res judicata. The article investigates the impact of decisions handed down by the Court on legal certainty, highlighting how they affect acquired rights and the sovereignty of res judicata. The critical analysis of the work shows that, although res judicata is a relevant institute for the stability and trust of the legal system, the subsequent interpretations of the Federal Supreme Court have the strength to challenge the immutability of decisions. The problem that guides this research is to seek to demonstrate how the Supreme Court's decision weakened res judicata and legal certainty. The work uses the deductive method.
