THE REPETITION OF THE PAST IN THE PRESENT: COMPULSORY HOSPITALIZATIONS IN THE STATE OF SANTA CATARINA AND THE VIOLATION OF PUBLIC POLICIES FOR SOCIAL INCLUSION
Abstract
There's a famous phrase attributed to Karl Marx that says: 'History repeats itself, first as tragedy, second as farce.' This indicates that when certain events occur once, it's entirely possible, but the second time, it's a farce, a copy. When studying about the anti-asylum movement after the Brazilian Holocaust in Barbacena/MG, from 1934 to 1979, the first question that arises for many scholars is how such an event should be remembered, to never be repeated again. In Florianópolis/SC, in 2024, a bill aims to establish involuntary commitments for addicts and homeless individuals, with the intention of reducing urban crime, even after a disaster that marks over 60,000 deaths in the country's history. The repetition of the past, so clearly, leads to the following question as a problem: does the approved bill for involuntary commitment in the City Council of Florianópolis represent a regression in the treatment and referral of homeless individuals in favor of the gentrification of the city? Thus, the general objective is defined as analyzing the gentrification process of the city of Florianópolis/SC, through the involuntary commitment of homeless individuals and how it violates the rights of social inclusion and fundamental guarantees provided in the Federal Constitution of 1988 in this regard. The methodology applied will be the deductive method, with monographic procedure, and the research techniques will be bibliographic and documentary. In advance, it is already concluded that such practice, in addition to violating the right to come and go, can be a major setback in the right to social inclusion and social fundamental rights.Downloads
