Abstract

The aim of this scientific article is to investigate the violation of the fundamental right to the environment as a result of planned obsolescence. In view of this objective, the research aims to answer whether the purposeful action of manufacturers to reduce the useful life of their products, aiming for greater profits from their rapid replacement, violates the fundamental right to the environment, as it contributes significantly to environmental damage resulting from the disposal of solid waste. To answer this question, the historical evolution of human rights will first be analyzed, as well as the right to an ecologically balanced environment and the phenomenon of planned obsolescence. In order to achieve the established objective, the qualitative research method will be used, through bibliographical research, relating aspects concerning the fundamental right to the environment and its violation by the premature disposal of products related to planned obsolescence.
