LEGISLATIVE PROCESS AND SOCIAL PARTICIPATION: THE EXPERIENCE OF THE STATE CODE FOR PERSONS WITH AUTISTIC SPECTRUM DISORDER IN PARANÁ

Abstract

Recently, the Legislative Assembly of the State of Paraná approved Bill no. 710/2023, “State Code for Persons with Autistic Spectrum Disorder”, which is the first state codification that brings together, in a single law, the state policy on autistic people. The legislative process of drafting codes within the scope of the Legislative Assembly of the State of Paraná involves a special procedure regulated by the Internal Regulations of that house, which includes social participation. The article aims to describe how social participation influenced the approved wording of the State Code for Persons with Autistic Spectrum Disorder in Paraná, strengthening the idea that an effective participatory democracy, which finds instruments of action in the postulates of a democratic administrative law that is also effective from social participation in the legislative process. The methodology used will be the description of the case, based on the analysis of what is contained in Bill no. 710/2023 of the Legislative Assembly of the State of Paraná and the experience of the author who was involved in the entire legislative process.
