JUDICIAL DIALOGUES IN THE IUS CONSTITUTIONALE COMMUNE ON DISCRIMINATION AGAINST WOMEN: ANALYZIS OF MEXICO AND BRAZIL

Abstract

In the face of a scenario of structural discrimination against women observed in Mexico and Brazil, constitutional courts of these states have been advancing in the protection of women's rights. This study aims to analyze how these courts have engaged with inter-American precedents due to their explicit adherence to the inter-American human rights system, in order to understand the stance they have taken in the dialogic construction of a Ius Constitutionale Commune in Latin America aimed at transforming the conditions of discrimination and oppression against women. The deductive, analytical, and comparative method was employed through doctrinal and jurisprudential bibliographic research. The study revealed a converging trend of national constitutional decisions with inter-American standards, advancing judgment with a gender perspective and demonstrating how the integrated network of judges can strengthen the protection of women's rights.
