HABEAS CORPUS N. 191.836: CONSEQUENCES, INTERPRETIVISM AND CONSEQUENTIALISM

Abstract

This article aims to reflect the decision of Minister Marco Aurélio in Habeas Corpus n. 191.836, who released André Oliveira Macedo, nicknamed “André do Rap”, leader of the First Capital Command (PCC), twice convicted of transnational drug trafficking. Also addressed will be the new decision taken by the plenary of the Brazilian Supreme Court, its developments and some reflections that aim to bring the consequences of this decision in the factual and legal world, as finally possible relations (or not) with legal consequentialism or with interpretativism.
