INTERNATIONAL LAW AND THE PROTECTION OF THE RIGHTS OF CHILD AND ADOLESCENTS RESPONSIBLE FOR LAW INFRACTION

Abstract

The theme of the research concerns the rights of child and adolescents responsible for law infraction. The delimitation of the investigation is structured in the study of mechanisms and instruments for protecting child and adolescents responsible for law infraction, considering both Brazilian laws and International Law. The research presents as its general objective to analyze the influence and applicability of international law norms in protecting the rights of child and adolescents in conflict with the law. With this purpose, the specific objectives proposed are: to discuss the legal protection of child and adolescents responsible for law infraction in Brazilian law; to present international instruments for protecting child and adolescents in conflict with the law; and to investigate the influence and applicability of International Law in protecting child and adolescents responsible for law infraction. As a research problem, the question is: how do international instruments for protecting the rights of child and adolescents responsible for law infraction influence and are applied in effectively guaranteeing these rights? The study methodology consists of using the deductive and monographic method, using documentary and bibliographic research techniques. With the development of the research, it was found that the international instruments, when combined with national laws, have the potential to guarantee the rights of child and adolescents responsible for law infraction. However, a difficulty of enforcement persists due to the lack of compliance with these instruments.
