EXPLORING THE EFFECTS: JUDICIAL PUBLIC POLICY FOR THE ADEQUATE TREATMENT OF CONFLICTS UNDER ANALYSIS
Abstract
With the results that this research intends to achieve, it will seek to understand whether there is transformative viability, in a positive sense, to the central concept of access to a fair legal order. Therefore, the main objective that is intended to be achieved is to observe whether the current judicial public policies have the capacity to crystallize the scenario and build means that overcome the difficulties encountered. In this regard, the problem that will be faced during the development of the text originates in the fact that it is not preliminarily detected that the evaluative actions have the power to change forensic practice and, with this, transform the current context of access to civil justice into the Brazil. To examine the proposal, it was decided to use the bibliographic research method. In the end, it was concluded that the lack of qualitative evaluative mechanisms, the consolidation of the self-compositional culture becomes deficient, and, with this, the transformation that is intended through alternative methods of conflict resolution lacks a structural basis that would bring meaning to all the directions, starting with the eventual litigant until arriving at the usual one. For this, partners such as educational institutions and public law appear, which have a lot to contribute to the paving of this transformation that is intended in the scenario of civil actions.Downloads
