GENDER INEQUALITY IN THE LABOR MARKET AND THE APPLICABILITY OF RESOLUTION 492/2023 OF THE NATIONAL COUNCIL OF JUSTICE IN THE DECISIONS OF THE REGIONAL LABOR COURT OF THE 4TH REGION

Abstract

The theme of this article is the analysis of the perspective of gender equality in the labor market. The objective is to verify whether the decisions of the Regional Labor Court of the 4th Region are following the protocol for judgment with a gender perspective according to resolution 492/2023. To this end, the deductive approach method was used, based on Labor Legislation, Constitutional Legislation and resolution 492/2023, and theoretical deepening through bibliographical research in books, articles and news. The research problem consists of the following question: What is the applicability of resolution 492/2023 in the decisions of the Regional Labor Court of the 4th Region? The conclusions of the work refer to the judicial decisions analyzed. In general terms, the research indicates that the majority of the Regional Labor Court of the 4th region is absolutely following the gender protocol for trials.
