Abstract

This research aims to analyze, through the hypothetical-deductive approach method and the bibliographic procedure method, the legal regulation of mediation in Brazil. The conception of access to justice as access to the just legal order, established by Kazou Watanabe methodologically guided the study. The work was developed with reference to the Constitutional principles that guide the Justice System and the principles of mediation. It is understood that the hypothesis of gaining efficiency in justice through mediation is confirmed when the maximum effectiveness of the principles of mediation and the mitigation of procedural aspects of the rule are observed.
